By using the AdviceOnly app (“the App”), you agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional terms or conditions that may apply to specific sections of the App or to products and services available through the App. If you do not agree with any of these terms, you may not access or use the App.

Educational Purposes Only: All courses, materials, and content provided through the App are intended for informational and educational purposes only. They are not intended to be a substitute for professional financial advice. You should always consult with a qualified financial advisor, tax advisor, or estate planning attorney before making any investment or financial decisions.

Our website’s information, app, and support materials may contain typographical errors or inaccuracies. We reserve the right without any obligation or notice to change, correct, or improve the information and course materials, as well as the ability to remove, suspend, or deny access to course materials for any reason.

Services are provided “AS IS,” and Hall Financial Services d/b/a Advice Only makes no representation or warranty to the licensee with respect to services provided. Hall Financial Services d/b/a Advice Only disclaims and licensee waives any and all implied warranties, including warranties of originality, accuracy, completeness, timeliness, non-infringement, merchantability, and suitability for any purpose.

Hall Financial Services, Inc. d/b/a Advice Only takes no responsibility for any loss or damages that could be associated with access by any third party including information you may input or that made available to you through the use of the app.

Hall Financial Services, Inc d/b/a Advice Only, nor any third-party vendor will be held liable or have any responsibility for any loss or damages incurred as a result of any failure or interruption of the app or resulting from acts or omissions for any services available to you due to the ability or inability to access app data contained herein, whether or not the cause was controllable or not by Hall Financial Services, Inc d/b/a Advice Only or any 3rd party servicer.

Where applicable laws do not allow the limitation of liability in the manner described, Hall Financial Services, Inc. d/b/a Advice Only total liability shall not exceed the amount you paid for accessing our services.

This app contains links to third party references intended as non-solicitors or government agencies and is for informational purposes only. Links do not represent an offer or recommendation to buy or sell any security or financial instrument. No link is intended or should be construed as investment advice.

The app may occasionally experience unanticipated outages or capacity limitations. Hall Financial Services, Inc. d/b/a Advice Only cannot guarantee you continuous, uninterrupted, or secure access to our systems.

License: AdviceOnly grants you a limited, non-exclusive, non-transferable license to access and use the courses and materials as stipulated below for your personal, non-commercial use.

You agree to

Use an unrooted Play or Apple store-certified device (e.g., smartphone or tablet) to display in-app purchased course written content, videos, and assessments.
Access Google Sheets, Apple Numbers, and PDF course exercises by linking via your device's web browser and use materials only as intended for personal, non-commercial purposes.
Print, download, or copy linked Google Sheets, Apple Numbers, and PDF course exercises only as intended for your personal, non-commercial use and in compliance with any applicable third-party terms of service.

You agree NOT to

Use any robot, spider, scraper, or other automated or non-automated means to access the App’s content for any purpose other than those stated under the stated uses.
Circumvent any measures we may use to prevent or restrict access to the App.
Decompile, reverse engineer, or disassemble any software or other products or processes made available through the app or accessible through the app.
Insert any code or product or manipulate in any way the content of the app or materials made accessible through the app.
Engage in unauthorized use of the app’s systems, misuse of passwords or 2-factor authentication, misuse of any other information, or impeded upon the enjoyment of services by any other party.
Gain unauthorized access to any of our services, computer systems, users, or networks through hacking, password mining, or any other means.
Use any system or software to extract data from the app or materials made accessible through the app aside from those in these terms of use.

All content included in or made available through the App, such as text, graphics, logos, button icons, images, video, digital downloads, data compilations, and software are the property of Hall Financial Services, Inc. d/b/a Advice Only or its 3rd party suppliers and is protected by United States and international copyright laws. The app’s trademark Advice Only(r), AO shape logo, and 3rd party logos are registered trademarks or service marks. You are prohibited from using any marks for the purpose of including, but not limited to, their use in metatags on websites or other locations without the expressed written permission of Hall Financial Services, Inc. d/b/a Advice Only or the appropriate third party provider.

The App and all information, content, materials, products, and services included in or made available through the App are provided on an “as is” and “as available” basis. Hall Financial Services, Inc. d/b/a Advice Only makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, products, or services included in or made available through the App. By use of our services you expressly agree that using the App is at your sole risk.

Hall Financial Services, Inc. d/b/a Advice Only will not be liable for any damages of any kind arising from the use of its courses and materials, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Hall Financial Services, Inc. d/b/a Advice Only provides educational materials, publishes the Advice-Only Methodology, and may provide information about adviosrs or professionals who independently choose to apply the methodology. Users are responsible for independently selecting and engaging any third-party professional. While Hall Financial Services, Inc. d/b/a Advice Only provides educational courses and resources through its app, it does not provide financial advice itself. Any engagement with a Third-Party Advisor is solely between you and the Third-Party Advisor and is governed by a separate agreement between you and the Third-Party Advisor. While Hall Financial Services, Inc. d/b/a Advice Only provides annual training to ensure advisors are educated and follow our methodology and process, we can not guarantee, monitor or effectively require their adherence to our policies.

By using our services and Third Party Advisors, you acknowledge and agree that Hall Financial Services, Inc. d/b/a Advice Only:

Is not a party to any agreement between you and a Third-Party Advisor.
Does not endorse, recommend, or monitor the business practices of any specific Third-Party Advisor.
Is not responsible for the advisory services provided by any Third-Party Advisor.
Disclaims any liability for any loss or damages arising from the Third party advisor’s solicited content within the app, on our website, through other resources, or any interactions with a Third-Party Advisor.
You are solely responsible for evaluating the qualifications and suitability of any Third-Party Advisor before or while engaging their services. You should independently verify any information provided by a Third-Party Advisor and seek additional advice from qualified professionals as needed.

This information contained in our app is for informational purposes only and should not be considered legal, tax or financial advice. You may want to consult with an attorney, tax professional or financial professional to ensure compliance with all applicable laws and regulations. You retain all ownership rights to the personal information you provide while using the App. Hall Financial Services d/b/a Advice Only does not claim ownership over this data or utilize this data for business purposes beyond what’s necessary to service your account and maintain the integrity of our systems. Hall Financial Services d/b/a Advice Only and any Third-party advisors do not have the ability to access, sell, or share the data you enter into the app. In extremely rare cases, our developers may need to diagnose issues with our software, which could, in theory, expose them to your data. In no way is Hall Financial Services d/b/a Advice Only to be found liable for violating this policy in these unintended software development and diagnosis situations.

While we make your information accessible to you in the app, we cannot guarantee that it will always be available. For example, if you decide to delete the app, lose access to our services, or manually delete the information, we cannot guarantee that an error or mistake will not cause you to temporarily or permanently lose your data. You should record the information you need to ensure access to it in the future.

Users are permitted to delete their account in-app, including any information inputted into the system, by visiting their profile in-app and selecting “delete account.” This action is irreversible, and we have no ability to reinstate the information.

Data Export: Currently, users cannot export their data from the app. This means users cannot use any automated or manual systems or software to extract data, which includes the use of robots, spiders, or scrapers. Users may instead retain the app on their devices to reference assessments. Alternatively, users are permitted to take screen grabs of their inputs into the assessments section for their personal records. This method permits users to archive their responses without the need to maintain the app on their device. Furthermore, as long as a user does not utilize the “delete account” feature, they should be able to retain access to their saved assessments by re-downloading the Advice Only app and logging back into their account using the email and password they initially used when setting up the account.

Hall Financial Services, Inc. d/b/a Advice Only reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of the App following any changes to these Terms and Conditions constitutes acceptance of any potential changes.

These Terms and Conditions shall be governed by and constructed in accordance with the laws of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms and Conditions or use of the App, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration will be held in San Francisco, California.
